The Complaint – LGO findings

1.  The complainant, Mr Dawson, complains the Council has wrongly allowed a developer to build and keep a boat shed despite many public objections. In particular he says:

  • It wrongly said the boat shed conformed with approved plans
  • It has not taken enforcement action against the boat shed
  • There has been a lack of information and public consultation
  • It took 15 months for the Council to admit the boat shed did not have planning permission.

Correct,  but after defining the Ombudsman’s role and powers in the first few paragraphs she spends the next 39 making the Council’s Case, somehow missing the overruling  of the Case Officer by the Planning Manager, the continued use of conflicting drawings by the Head of Development Services and an anonymous Senior Planning officer who directly supplied drawings produced in 1997, to the LGO, saying they were approved drawings from 1996.

The Inspector has taken the Developers/Council’s word against the claimant. She has ignored the fact that UK Docks were building the shed 2.7m too high according to approved plans, being persuaded that plans that show no evidence of having been near the Tyne and Wear Development Corporation have been approved by them.

UK Docks Expansion  – Put back to 1st Feb

Melanie has heard back from South Tyneside Council who say the UK Docks planning application which if approved will have a huge negative effect on the whole of Greens Place and River Drive has been put forward to be heard at the Planning Committee on 12th January 2016, no public have been officially informed of this yet but UK Docks has been informed.

She says, please, we need to get as many members of the public in the public gallery for this committee meeting, strength in numbers.

Beacon Public House – Put back to 1st Feb

The Committee  decided to do a site visit.

Two and a bit years ago.

First Meeting of Residents/Householders about the Shed

In October 2013 Local Residents (20 or so) met in the Littlehaven Hotel, South Shields, to discuss the Shed or Slipway Cover being constructed by UK Docks, nearby, in River Drive. The meeting agreed that the shed was built much higher than planned but this was difficult to prove because the plans provided by the Council could be interpreted to indicate that the height was not materially different from that planned and anyway the Council would not say how high the framework was.

Proposal: Demolition of the existing single storey office block and workshop/winch house with additional office and storage accommodation on its roof. The existing buildings will be replaced with a new 2 storey office block, workshop with winch house and mezzanine floor to provide a staff canteen, managers office, kitchen and sanitary facilities, an extension to the existing boat shed, an additional boat shed (to match existing) and a new jetty. The existing vehicular access is to be relocated.

2nd Docks Shed

is on the stocks again. ST/0461/14/FUL
Get your complaint in before the end of September – make sure you mention that the first one is 3 meters too high and has been built without planning permission. On current form UK Docks will be allowed to build the second one the same height as the first. UK Docks have built the first one higher and wider than planned.  The Council say it is not higher than planned but we do not think that is true because in two years neither they nor UK Docks have produced any authorised plans to support their opinion.ElevationNo6
Elevation 6. The river end. Notice the second shelter is the height that the first should have been and they are going to extend the first one so that the ferry will fit!  The first shed has been built 3m higher than planned to accommodate a travelling crane which probably upgrades the use of the boat yard from light to heavy engineering (B1/B2 argument).

Only in South Shields

can a structure as big a UK Dock’s shelter be built without planning permission.
There seem to be two camps:-

The ‘Legal’ camp and the built without planning permission one.
Case Officer You and I etc.
Chairman and Treasurer TGA  Petitioners
 Head of Development Services: Planning Manager:
 Confuses opinions with facts. It took four weeks to sway him.
LG Ombudsman:  Customer Advocacy:
(it appears that the investigator was not told all the facts about the shelter) It took 2 months to sway them.
MP for South Shields
Won’t say.
CEO of South Tyneside Council has yet to declare.
If he comes down on this side he may have to overrule his legal section.
If he comes down on our side, does the shelter get pulled down?

For Immingham.

  • Create jobs in a not such a deprived area.
  • Extensive connections via the waterways, which is very ‘green’ to entire canal system including navigable rivers.

Remodelling of The Harbour View

‘The Harbour View’ for the first year of its life was mostly concerned with UK Docks slipway shed, aka. cover or shelter.

The author had some outstanding issues with the planning department of STC when the slipway shelter was started and he would like to return to these.

During the year 2015 other things came into focus as well so it became necessary to split theharbourview.co.uk  into parts:

  • Expansion of Port of Tyne Biomass Handling Facility /biomass;
  • Regeneration Plan for South Shields /ss365;
  • UK Docks slipway shelter /shed.
  • Not quite right? /etcetera.
